1. Acceptance of Terms

By accessing or using Tatan, a construction project management platform developed and operated by PT Rancang Nusantara Teknologi for and on behalf of Acme Corp (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including administrators, project managers, supervisors, and workers.

PT Rancang Nusantara Teknologi acts as the technology provider and system operator, while Acme Corp is the primary customer and data owner.

2. Description of Service

Tatan is a cloud-based construction project management platform that may include the following features:

  • Project tracking and management
  • Site diary and daily reporting
  • Worker and labor management
  • Material requests and inventory tracking
  • Subcontractor job and quotation management
  • Photo documentation and verification
  • AI-powered summaries and analytics (optional)
  • WhatsApp notification integration (optional)

Feature availability may vary based on configuration, subscription, or organizational settings.

3. User Accounts

3.1 Account Creation

User accounts are created and managed by organization administrators. By using an account, you represent that:

  • You are at least 18 years of age
  • The information you provide is accurate and complete
  • You are authorized by your employer to use the Service
  • You will use the Service only for legitimate work-related purposes

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities conducted under your account
  • Promptly notifying your administrator of any unauthorized access
  • Using strong passwords and enabling two-factor authentication when available

3.3 Account Suspension and Termination

Your organization’s administrator may suspend or terminate your account at any time.

Upon termination:

  • Your access to the Service will be revoked
  • Organizational data may remain accessible to administrators
  • Data may be retained in accordance with contractual, operational, or legal requirements

Organization administrators may access, export, modify, or delete organizational data in accordance with their role permissions and applicable law.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful or unauthorized purpose
  • Share login credentials or allow unauthorized access
  • Attempt to access accounts, systems, or data without permission
  • Upload malicious software, viruses, or harmful code
  • Upload false, misleading, or fraudulent information
  • Falsify location data, timestamps, or verification photos
  • Scrape, harvest, or extract data from the Service
  • Use the Service for competitive analysis, benchmarking, or resale without authorization
  • Reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations

5. User-Generated Content

5.1 Content Ownership and License

You retain ownership of content you upload to the Service, including photos, documents, and data.

By uploading content, you grant PT Rancang Nusantara Teknologi a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze (including via AI systems), transmit, and display such content solely for the purpose of operating, securing, maintaining, improving, and providing the Service.

5.2 Content Responsibility

You are solely responsible for the content you upload and represent that:

  • You own or have sufficient rights to the content
  • The content does not infringe third-party rights
  • The content is accurate and not misleading
  • The content complies with applicable laws and regulations

5.3 Content Removal

We reserve the right to remove or restrict access to content that violates these Terms or applicable law, with or without prior notice.

6. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which describes how personal data is collected, processed, stored, and protected.

7. Intellectual Property

7.1 Our Property

The Service, including its software, design, features, documentation, and underlying technology, is owned by PT Rancang Nusantara Teknologi and protected by applicable intellectual property laws.

You may not copy, modify, distribute, or create derivative works without prior written permission.

7.2 Trademarks

“Tatan” and all related logos and marks are trademarks of PT Rancang Nusantara Teknologi. Unauthorized use is prohibited.

8. Third-Party Services

The Service integrates with third-party services, including but not limited to Supabase, Google, and Meta/WhatsApp.

Your use of such services is subject to their respective terms and policies. PT Rancang Nusantara Teknologi is not responsible for third-party services.

9. Service Availability

9.1 Uptime

The Service is provided on a commercially reasonable basis. We do not guarantee uninterrupted or error-free operation.

Service interruptions may occur due to:

  • Scheduled maintenance
  • Emergency updates
  • Force majeure events or factors beyond our control

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • DATA ACCURACY OR COMPLETENESS
  • UNINTERRUPTED OR ERROR-FREE OPERATION

AI-powered features are provided for assistive and informational purposes only and must not be relied upon as the sole basis for operational, safety, legal, or financial decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PT RANCANG NUSANTARA TEKNOLOGI AND Acme Corp SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from use or inability to use the Service
  • Damages caused by third-party services or user content

Total liability shall not exceed the fees paid by Acme Corp for the Service in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PT Rancang Nusantara Teknologi and Acme Corp from claims arising from:

  • Your use of the Service
  • Violation of these Terms
  • Violation of third-party rights
  • Content you upload or submit

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

14. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in Indonesia.

15. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement regarding the Service and supersede prior agreements.

17. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
